TERMS OF SERVICE
1. AGREEMENT TO TERMS
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "customer," or "user") and New England RC LLC ("Company," "we," "us," or "our"), a Massachusetts limited liability company.
By accessing or purchasing from newenglandrc.us (the "Site") or using any related services (collectively, the "Services"), you agree to be bound by these Terms.
If you do not agree, you must not use the Services.
2. ELIGIBILITY
You must be at least 18 years old to use this Site or purchase products.
3. PRODUCTS AND AVAILABILITY
We make reasonable efforts to ensure product accuracy, but we do not guarantee:
- Specifications
- Compatibility
- Availability
- Accuracy of descriptions
All products are subject to change or discontinuation at any time without notice.
4. HIGH-RISK PRODUCTS AND SAFETY DISCLAIMER
Certain products sold by New England RC LLC include high-performance electronics and power systems, including but not limited to:
- Lithium batteries (LiPo / LiHV)
- Battery chargers
- Electronic speed controllers (ESCs)
- RC aircraft and related components
These products are inherently dangerous and may result in:
- Fire
- Explosion
- Electrical failure
- Property damage
- Personal injury or death
By purchasing and/or using these products, you acknowledge and agree:
- You understand the risks involved
- You are experienced and competent in safe operation
- You will follow all manufacturer instructions and safety practices
- You assume all risk associated with use
All products are used entirely at your own risk.
5. BATTERY AND CHARGING SAFETY
Lithium batteries and charging systems require strict safety procedures.
You agree that you will:
- Use only compatible chargers and correct settings
- Never leave batteries unattended while charging
- Monitor battery temperature and voltage during use
- Store batteries in a fire-safe environment
- Discontinue use of damaged, swollen, or compromised batteries
We are not liable for:
- Battery fires or thermal runaway
- Property damage
- Injury or death
- Improper charging, storage, or handling
6. LiHV (4.35V) BATTERY ACKNOWLEDGMENT
High Voltage Lithium Polymer (LiHV) batteries require additional care and monitoring.
By purchasing LiHV batteries, you acknowledge:
- These are high-performance products requiring voltage and temperature management
- Improper use may result in overheating, reduced lifespan, or failure
- You have reviewed the LiHV Battery Disclaimer and Usage Guide
If you do not understand these requirements, you agree not to purchase or use LiHV products.
7. RADIO-CONTROLLED PRODUCT USE
RC aircraft and related systems can fail without warning and cause serious harm.
You agree:
- You are solely responsible for safe operation
- You will operate in safe environments
- You will comply with all applicable laws (including FAA regulations where applicable)
- You assume all risks of operation
8. PRODUCT USE, INSTALLATION, AND MODIFICATION
We are not responsible for any damage or injury resulting from:
- Improper installation
- Incorrect wiring or setup
- Use of incompatible components
- Product modification
- Operation outside intended use
Any modification or misuse voids all responsibility on our part.
9. ORDERS, PAYMENT, AND PRICING
You agree:
- To provide accurate billing and payment information
- To pay all charges including shipping and taxes
We reserve the right to:
- Refuse or cancel any order
- Correct pricing errors
- Limit quantities
Title and risk of loss pass to the customer upon delivery to the carrier-confirmed address, including freight forwarders and reshipping facilities.
10. RETURNS AND REFUNDS
Returns are governed by our Return Policy, which is incorporated by reference.
All customers agree to the Return Policy at the time of purchase.
10A. FREIGHT FORWARDERS / RESHIPPING SERVICES
We reserve the right to refuse, cancel, or hold any order shipped to a freight forwarder, package forwarding service, or reshipping warehouse.
Orders shipped to such addresses are accepted at the customer’s sole risk.
By placing an order using a forwarding address, you agree to the following:
- Delivery to the forwarding facility constitutes final delivery and fulfillment of the order
- Responsibility transfers to the customer once the carrier marks the package as delivered
- We are not responsible for loss, damage, delays, theft, or mishandling after delivery to the forwarding service
- Orders shipped to freight forwarders may be ineligible for return, refund, exchange, or support
- We may require additional verification or cancel any order suspected of using a forwarding service
11. PROHIBITED USE
You may not use the Services to:
- Violate any laws
- Commit fraud
- Interfere with the Site
- Use or resell products in unsafe or unauthorized ways
12. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "WITH ALL FAULTS."
WE DISCLAIM ALL WARRANTIES, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
WE DO NOT GUARANTEE:
- Product performance
- Compatibility
- Error-free operation
13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
NEW ENGLAND RC LLC SHALL NOT BE LIABLE FOR:
- FIRE OR EXPLOSION
- PROPERTY DAMAGE
- PERSONAL INJURY OR DEATH
- INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT.
14. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless New England RC LLC and its owner from any claims, damages, or expenses arising from:
- Your use or misuse of products
- Battery or charging incidents
- RC operation
- Failure to follow safety procedures
- Product modification or improper installation
15. USER RESPONSIBILITY
You are solely responsible for:
- Understanding product use
- Following all safety guidelines
- Ensuring compatibility
- Safe operation and supervision
If you do not understand how to safely use a product, do not use it.
16. INTELLECTUAL PROPERTY
All content on the Site (logos, text, images, design) is owned by New England RC LLC and may not be used without permission.
17. THIRD-PARTY LINKS
We are not responsible for third-party websites, products, or services.
18. TERM AND TERMINATION
We may terminate or restrict access to the Services at any time, for any reason, without notice.
19. GOVERNING LAW
These Terms are governed by the laws of the Commonwealth of Massachusetts.
20. DISPUTE RESOLUTION
All disputes shall be resolved in the state or federal courts located in Massachusetts.
Claims must be brought within one (1) year.
21. CHARGEBACKS AND PAYMENT DISPUTES
By placing an order, you agree to:
- Contact us first to resolve any issue
- Not initiate a chargeback without attempting resolution
We reserve the right to provide order records, policy acceptance data, delivery confirmation (including freight forwarders), and communication history to payment processors in response to disputes.
22. CHANGES TO TERMS
We may update these Terms at any time. Continued use of the Services constitutes acceptance of changes.
